Requesting Public Records

Public records laws allow individuals to request access to government records maintained by public agencies. While procedures vary by state and agency, most requests follow a similar process.

When submitting a request:

identify the agency likely to possess the records,
describe the records as specifically as possible,
keep copies of all communications,
and track agency response deadlines.

Some agencies may require:

written requests,
identity verification,
fee estimates,
or specific submission methods.

Tips for Effective Requests

  • Ask for records, not answers to questions
  • Be specific about dates, names, and record types.
  • Avoid overly broad requests when possible.
  • Request electronic copies when available.
  • Ask for retention policies or audit trails if relevant.
  • Ask for attachments, metadata, and audit logs if relevant
  • Maintain a timeline of responses and follow-up communications.
  • Use names, dates, addresses, case numbers, or incident numbers when possible
  • Always retain copies of submitted requests and agency responses

Understanding Delays and Denials

Agencies may:

  • extend response deadlines,
  • request clarification,
  • redact portions of records,
  • or deny records under statutory exemptions.

If records are denied, request:

the legal basis for the denial,
the specific exemption cited,
and information regarding appeal or review procedures.
